What is it about?
The Social License to Operate (SLO) is a concept originally developed in managerial sciences. Nonetheless, it could be judicialised when relevant for the settlement of an international investment dispute. In this process, national public interest plays a preponderant role.

Why is it important?
Current investment arbitration case law has not a uniform approach for the settlement of social conflict disputes. The approach of this paper aims to balance the rights of investors and affected communities, favouring predictability in the settlement of future social conflict related disputes.
