What is it about?
This article proposes a new law which takes the idea of corporate due diligence and applies it to the field of UK labour law. Multi-national companies are increasingly obliged to monitor their activities to prevent or remedy human rights and breaches of other laws which arise as a result of their commercial operations. In the absence of effective state-based enforcement of labour law and with employees typically unwilling to enforce their rights under labour law unless they are unlawfully dismissed, this new law will fill an enforcement gap until such time as state-based enforcement mechanisms are adequately funded.

Labour law due diligence would force employers to take responsibility for ensuring that they comply with UK labour law and would provide valuable information to employees and state-based regulators.
