What is it about?

Transnational courts - operating beyond State borders- have elaborated different notions of same sex marriage over the time. Whereas in the past they followed a conservative approach, they are now more willing to take into account changes in societal perceptions and as a result allow reconfiguring the right to same sex marriage. However, no achievement in terms of human rights should be taken for granted.

Why is it important?

This work is important, because it looks at the evolution of the right to same-sex marriage across legal systems and times. It shows how interpretations of human rights by courts may influence each oher, but may sometimes prouce contradictory results within the same jurisdiction.
